The Hon'ble Supreme Court has, categorically held in State of Kerala v. Kalliyanikutty [1999 (2) KLT 146 (SC)] that recovery can be effected under the Revenue Recovery Act, only if recovery is initiated within the period of limitation.

The Revenue Recovery Act, does not efface limitation or provide for getting over the limitation as provided under the Limitation Act, 1963.

The period of limitation would be three years from the date of last repayment scheduled in the original agreement.
